General Terms and Conditions of Sale
1. OBJECT.
1.1 BRT Services Limited offers you the services advertised on our website in accordance with the following General Terms and Conditions of Sale (hereinafter referred to as the “General Terms and Conditions”). By booking any of the services offered on our website, you unreservedly accept the obligations set forth in these General Terms and Conditions.
1.2 By following all the steps involved in contracting the services and placing the purchase order, you express your full and unreserved acceptance of each one of the General Terms and Conditions published at the time you access the website. You must carefully read the General Terms and Conditions every time you request any services offered on this website.
1.3 BRT Services Limited takes full responsibility for all transactions from the website, including handling and dispute management, refunds, cancellations, and customer support.
1.4 It is recommended that booking of tours be made seven days in advance of the tour date.
2. CONTRACTING SERVICES.
2.1 BRT Services Limited offers a set of organized tours for private groups, as stated in the “Tours” section of our website.
2.1.1 The description of the service/tour on the website is intended to communicate a representative experience for the customer. The actual tour experience on any particular day may differ (e.g., tour route, sites visited, information given, etc.) due to various reasons such as safety concerns, water levels, weather and other external factors like events.
2.2 You are responsible for the use you make of the services and hold BRT Services Limited harmless from any liability arising from any damage caused by the correct or incorrect use of the contracted service provided by BRT Services Limited or its third-party suppliers. Our services are for personal use only, not for commercial use. Resale of the contracted services for any commercial or competing business is not permitted unless otherwise agreed in advance.
3. BOOKING POLICY
3.1 Any booking made in your name or on your behalf will be considered as having been made by you.
3.2 Once your booking is complete and the required deposit has been successfully transferred, you will receive a confirmation email. If you do not receive this email, please check your spam folder. If you still do not see a confirmation from us, kindly contact us via email or phone.
Please be aware that your booking may be canceled in the event of unforeseen circumstances, acts of God, or force majeure that make it inadvisable to proceed with the tour.
3.3 BRT Services Limited reserves the right to cancel bookings made by people with whom there is a dispute regarding payment of a prior order or who are suspected of some kind of irregularity.
3.4 It is recommended that booking of tours be made seven days in advance of the tour date.
4. PRICE AND PAYMENT TERMS
4.1 Service Pricing and Payment:
- Once your booking is complete and the required deposit has been successfully transferred, you will receive a confirmation email. If you do not receive this email, please check your spam folder. If you still do not see a confirmation from us, kindly contact us via email or phone.
- Prices are displayed and paid in the local currency, Thai Baht. The balance due, which is the difference between the deposit and the tour price, must be paid in cash to our captain at the beginning of the tour.
5. CANCELLATION & REFUND POLICY
5.1 As a valued customer, when booking through our customer service or directly on our website, you can cancel your booking without any penalty up to 48 hours before the tour departure. Please contact us via email at contact@bangkokrivertours.com. If the booking is cancelled less than 48 hours before departure, we will retain the deposit to cover our incurred costs.
5.1.1 BRT Services Limited and its partners will not cancel tours deemed operable due to normal weather conditions in the local area. Normal weather can include conditions such as rain, heat, wind, minor flooding, etc. Only in severe weather conditions tours may be cancelled, and either a full refund or change of tour date will be provided based on the customer’s preference. For refunds, we will use the same currency and bank account that was used for the customer’s initial transfer to us.
6. Photo and Video Recordings of Participants
6.1 During our tours, our tour guides occasionally capture moments in the form of photos and videos (including audio). By participating in our tours, you consent to the use of these recordings on our social media channels (Facebook and Instagram).
6.2 The processing of these recordings is based on our legitimate interest in visually documenting the events we organize and reporting positively about them to a broader audience.
6.3 If you do not agree to such recordings and potential publication on social media, please inform your tour guide at the beginning of the tour.
7. APPLICABLE LAW AND JURISDICTION
7.1 The construction and enforcement of these general terms and conditions of sale shall be governed by Thai law. The courts of Thailand are the only competent courts to hear any dispute arising from the formalization, enforcement, or construction of any contract of sale entered into by BRT Services Limited and a customer, provided it is not considered a consumer as defined in the current law concerning consumer and user defence. The User states that he/she has read, is aware of, and accepts these conditions in their entirety.
7.2 BRT Services Limited is the owner of this website and holds all rights to the content, designs, pictures and other media.
